1. Who is the administrator of your data?

2. Why do we process your data?

In connection with the services provided through the mindandmatter.pl website, consisting of:

  • graphic design services,
  • UX/UI design,
  • website implementation,
  • technical support services,
  • sale of digital products and services (e.g., templates, online courses, e-books, online communities),

A. For the purpose of concluding or performing a contract (Article 6(1)(b) of the Regulation), your data will be stored until the contract is performed.

B. For marketing and promotion purposes of products offered by the Foundation for Entrepreneurship Development “Twój StartUp” based in Warsaw, which is our legitimate interest (Article 6(1)(f) of the Regulation). Your data will be processed until you object (if you do not send commercial information, please delete this point).

C. To fulfill all legal obligations incumbent on us in connection with the cooperation undertaken (Article 6(1)(c) of the Regulation), this purpose is related to the legal obligations to store certain documents for the period specified in the law, e.g.:

  • The Accounting Act of September 29, 1994 (Journal of Laws of 2017, item 1858);
  • The Tax Ordinance Act of August 29, 1997 (Journal of Laws of 1997, No. 137, item 926);
  • Act of March 1, 2018 - on counteracting money laundering and terrorist financing (Journal of Laws of 2018, item 723).

D. For the purpose of possible establishment, investigation or defense against claims, which is our legitimate interest (basis under Article 6(1)(f) of the Regulation). The data will be processed until the claims expire.

E. If you give your consent, your data will be processed within the limits and for the purpose specified in the consent (basis under Article 6(1)(a)). The data will be processed until the consent is withdrawn.

3. What data is processed?

In order to conclude a contract, we require you to provide data on the contract/order form (if you do not provide it, we will not conclude the contract/execute the order). Additionally, we may ask for optional data that does not affect the conclusion of the contract (if we do not receive it, we will not be able to, for example, call the contact number). During the term of the contract, while providing services, we obtain other data about you. The appearance of your personal data in our possession is a consequence of the services you use.

4. Who will the data be made available to?

  • A. Public authorities, to the extent that they do not receive data as part of specific proceedings based on law, e.g., in connection with anti-money laundering;
  • B. Entities that process your personal data on behalf of the Foundation on the basis of a personal data processing agreement concluded with the Foundation (so-called processors). These will include, among others: beneficiaries of the Foundation, IT specialists, archiving companies, hosting companies;
  • C. External data controllers (so-called Parallel Controllers to whom the data is made available, e.g., legal advisors and attorneys, entities providing courier or postal services, entities purchasing receivables - in the event of your failure to pay our invoices on time);
  • D. Entities located outside the EEA, but only when necessary and with an adequate level of protection, primarily through:
    • a. Cooperation with entities in countries for which a relevant decision has been issued by the European Commission;
    • b. The use of standard contractual clauses issued by the European Commission.

The controller always informs you of its intention to transfer personal data outside the EEA at the time of collection.

Where does mindandmatter.pl store personal data?Mindandmatter.pl stores your data as part of the Webflow service. The Webflow service stores data in the United States, where Webflow Inc. is based as a corporation registered in the state of Delaware at the following address: Webflow, Inc. 398 11th Street, 2nd Floor San Francisco, CA 94103.   • A. The right to access the personal data we process (Article 15 of the Regulation),
  • B. The right to rectify the personal data entrusted to us, including correcting it (Article 16 of the Regulation),
  • C. The right to have your personal data deleted from our systems, the so-called “right to be forgotten” - if you believe that there are no grounds for us to process your data, you can request that we delete it (Article 17 of the Regulation),
  • D. The right to restrict the processing of personal data - you may request that we restrict the processing of personal data solely to its storage or to the performance of activities agreed with you, if we have incorrect data about you or process it without justification; or you do not want us to delete it because you need it to establish, pursue, or defend claims; or for the duration of your objection to the processing of data (Article 18 of the Regulation),
  • E. Right to data portability – You have the right to receive from us, in a structured, commonly used, machine-readable format (e.g., “.csv” format), personal data concerning you that we hold on the basis of a contract or your consent. This right will apply if we hold the data in electronic format – if we only hold the data in paper form, you will not be able to exercise this right. You may instruct us to send this data directly to another entity (Article 20 of the Regulation).
  • F. Right to withdraw consent to the processing of personal data - you have the right to withdraw your consent to the processing of personal data that we process on the basis of consent at any time - Article 7(3) of the Regulation.   • G. Right to object - you may object to the processing of your data if the basis for the use of the data is our legitimate interest - Article 21 of the Regulation.
